Jimmy John’s delivery driver files nationwide collective action against Bacus Foods Corp. and owners

On May 3, 2023, a delivery driver at a Jimmy John’s in Lincoln, Nebraska filed a class action lawsuit against his employers, Bacus Foods Corp., BFCJJS106, LLC, Brandt Bacus, and Jared Bacus, for unpaid wages. The defendants operate Jimmy John’s stores in Nebraska, Kansas, Colorado, and Arizona.

The driver claims that the company does not reimburse them enough for the vehicle expenses they incur in the course of making deliveries. Drivers cover gas, vehicle repairs and maintenance, insurance, registration, and financing costs. But the company only reimburses them approximately 3% of each order they deliver. The plaintiff claims this was not enough to cover all of the vehicle expenses, causing his wage to fall below minimum wage.

The plaintiff seeks to represent all Bacus Foods delivery drivers in a nationwide collective action.
