Former MUY driver seeks approval of $4.5 million settlement for Minnesota delivery drivers

On March 28, 2024, John Stotesbery, a delivery driver who formerly worked for a MUY Brands Pizza Hut store, asked the District of Minnesota to grant preliminary approval of his proposed $4.5 million settlement.

The Lawsuit

Mr. Stotesbery’s lawsuit, filed in June 2022, alleged that both MUY and its successor, Ayvaz Pizza, underpaid him and his fellow delivery drivers by failing to properly reimburse them for the costs associated with using their cars to make deliveries.

Mr. Stotesbery alleged that MUY reimbursed $1.25 per delivery, which he claims was not enough to cover all of his vehicle costs, including insurance, maintenance, gas, etc.

The Settlement

MUY agreed to pay $4.5 million to settle the claims asserted by Mr. Stotesbery on behalf of the Minnesota delivery drivers who worked from June 21, 2019 to September 27, 2021.

The MUY Minnesota drivers do not have to do anything to participate in the settlement—they will receive a check by virtue of being a member of the class. We estimate that the settlement will result in the drivers receiving over $1,000 on average. The settlement allocation is based on the drivers’ miles driven and reimbursements paid, so drivers who completed more deliveries and drove more miles will receive a greater share.

The settlement does not resolve any claims of drivers who worked for MUY outside of Minnesota and it does not resolve the claims asserted against the Ayvaz defendants.

If the Court grants preliminary approval, a notice will be sent in the mail to all of the class members describing the settlement and their options in detail. After that, the Court will set a hearing, where it will hopefully grant final approval of the proposed settlement.
