Delivery drivers file nationwide collective action against Ayvaz and Palo Alto Pizza Hut locations

On February 13, 2023, a pizza delivery driver at a Pizza Hut in Truth or Consequences, New Mexico, filed a class action lawsuit against her employer Ayvaz Pizza, LLC, and former employer Palo Alto, Inc., for unpaid wages. This lawsuit is named Echeverria v. Ayvaz Pizza, LLC.

The plaintiff seeks to represent all Ayvaz Pizza delivery drivers in federal court. The plaintiff claims that Ayvaz and Palo Alto, Inc. broke the law because they failed to properly reimburse their delivery drivers for their automobile expenses.

Specifically, plaintiff argues that the drivers should have been reimbursed for their vehicle expenses at the IRS standard business mileage rate, which is currently $.655 per mile.

Defendant Ayvaz Pizza operates approximately 352 Pizza Huts across the United States. Sometime in 2021, Ayvaz Pizza purchased Pizza Hut stores from Palo Alto, Inc., a prior owner and operator of Pizza Hut stores.
