Delivery Driver sues Hut American Group Pizza Hut stores in Illinois

Biller & Kimble has filed a lawsuit on behalf of a pizza delivery driver in Illinois against one of Pizza Hut’s largest franchisees, the Hut American Group. The plaintiff worked for Pizza Hut in Springfield, Illinois, but seeks to represent all drivers nationwide who have worked for Hut American within the last three years.

Like many similar pizza delivery drivers around the country, the plaintiff argues that he and other drivers should have been reimbursed for their vehicle expenses at the IRS standard business mileage rate, which is currently $.655 per mile.

Plaintiff argues that Hut American did not maintain the records the law requires they keep relating to their vehicle expenses. As a result, because he is paid at or close to minimum wage, he contends that he can enforce his minimum wage rights by reference to the IRS rate. The plaintiff alleges that the company reimburses at a per-mile reimbursement rate far less than the IRS rate.

Biller & Kimble has filed previous lawsuits against Hut American but has later found out that the plaintiffs in those cases signed arbitration agreements with class action waivers.
