In a pair of lawsuits on behalf of pizza delivery drivers at Domino’s franchise locations in Kentucky, North Carolina, and South Carolina, Biller & Kimble, LLC’s attorneys filed motions to approve settlements totaling $4 million.
Huffman v. Team Carolinas, Inc.: $3 million settlement
On June 1, 2020 Biller & Kimble asked the federal district court in the Eastern District of North Carolina to approve a settlement for $3,000,000.00 against a Domino’s Franchise operated by Team Carolinas, Inc. The case is Huffman v. Team Carolinas, Inc., No. 4:19-cv-34 in the Eastern District of North Carolina.
Fox v. Team Goliath, Inc.: $1 million settlement
On June 30, 2020 Biller & Kimble asked the federal district court in the Eastern District of Kentucky to approve a settlement for $1,000,000.00 against a Domino’s Franchise operated by Team Goliath, Inc. The case is Fox v. Team Goliath, Inc., No. 5:19-cv-195 in the Eastern District of Kentucky.
The Claims in the Two Cases
In both Fox and Huffman, pizza delivery drivers alleged that their companies (both of which are Domino’s franchises, but are otherwise unrelated) under-reimburse their delivery drivers for expenses accrued through use of their own cars for delivery (including gas, insurance, wear and tear, and repairs). The drivers argued that companies must reimburse pizza delivery drivers in one of two ways:
1. Record each drivers’ actual expenses and reimburse the drivers that amount, OR
2. reimburse the drivers at the IRS business mileage rate ($.58 per mile in 2019).
These options come from the Department of Labor’s Enforcement Handbook. Even so, pizza companies often dispute that they are required to follow those rules.
