Biller & Kimble files unpaid wage lawsuit on behalf of delivery drivers in Alaska, Arizona, Utah, and Nevada against MP2 Enterprises, LLC

On September 27th, 2023, a pizza delivery driver at a Nevada Pizza Hut location filed a class action lawsuit against MP2 Enterprises, LLC and its owners seeking to recover unreimbursed vehicle expenses for the company’s delivery drivers. She seeks to represent all the delivery drivers at the company’s Pizza Hut locations in the class/collective action. The case is currently pending in the District of Utah.

The plaintiff alleges that drivers for MP2 Enterprises incur even more costs than what the IRS standard business mileage rate takes into consideration: increased wear and tear, accelerated depreciation, and insurance costs associated with using a personal car to make deliveries.

The plaintiff claims that these costs effectively cut into the minimum wages the drivers are required to receive. Specifically, she alleges the company’s practice violates the FLSA (Fair Labor Standards Act), the Nevada Constitution, Nevada wage & hour law, and also results in the company being unjustly enriched.
