On May 1, 2020, a former Papa John’s delivery driver filed suit against the companies known collectively as the Bajco Group, one of the largest franchise operators of Papa John’s Pizza stores.
The Plaintiff alleges that Bajco operates over 125 Papa John’s Pizza stores in Indiana, Illinois, Michigan, Ohio, New York, and Florida. The Plaintiff, a Papa John’s delivery driver who seeks to represent all Bajco delivery drivers in federal court, claims that Bajco Group broke the law when they underpaid drivers for automobile expenses.
The lawsuit alleges that Bajco was required to either keep track of and reimburse for the drivers’ actual expenses, or reimburse the drivers using the IRS standard business mileage rate, which is currently $.575 per mile.
The driver claims that the Papa John’s franchise operators have failed to meet this standard. Because of the underpayment, the driver claims that their effective wages dropped below minimum wage. Instead of using the IRS rate, the driver claims that the Papa John’s franchise operators reimburse a set, flat amount per delivery that falls far short of the IRS rate.
