Because the driver was already paid at or close to minimum wage, he claimed that any un- or under-reimbursed vehicle expenses resulted in a minimum wage violation and other wage law violations. Additionally, he claims that the company failed to properly pay him overtime by calculating his overtime rate as 1.5(x) his tipped wage rate while he was on the road delivering pizza.
