Biller & Kimble files unpaid wage lawsuit against Five Star Pizza

On June 23, 2025, a pizza delivery driver at a Florida-based pizza chain, filed a class action lawsuit against 987 Pizza Inc., John Gillespie, and Sandra Gillespie, alleged owners of Five Star Pizza. The driver is seeking to recover unreimbursed vehicle expenses. This lawsuit is named Biancaniello v. Five Star Pizza. He seeks to represent all of the delivery drivers at the company’s twenty-four locations in federal court.

The plaintiff alleges that the company has failed to properly reimburse the drivers for the vehicle expenses they incur while making deliveries. The pizza drivers are required to put their cars at risk delivering the company’s pizzas. In the process, the drivers cover major costs like gas, insurance, registration, and repair and maintenance costs. They also see their cars depreciate much faster than they otherwise would because they drive so many miles for the company. The plaintiff claims the company’s policy of not reimbursing its delivery drivers in any capacity for the miles they drive to deliver the company’s pizzas effectively cuts into the wages they receive. He alleges this practice violates the FLSA and Florida wage laws, and also results in the company being unjustly enriched.
