Former Pizza Hut delivery drivers have sued the Pizza Hut stores where they worked.
The drivers are seeking unpaid wages and damages because they claim the company failed to fully reimburse delivery drivers for vehicle expenses incurred delivering pizzas. The suit asserts claims against franchise operators CFL Pizza, LLC, Chaac Pizza Midwest, LLC, and their individual owners.
The lawsuit is similar to other “pizza delivery driver lawsuits” filed by our firm in recent years. Since 2018, we have helped drivers recover over $28,000,000 in unpaid wages, damages, attorneys fees, and costs.
The plaintiffs claim:
(1) Pizza Hut delivery drivers use their own cars to make deliveries.
(2) Pizza Hut delivery drivers are paid minimum wage, or close to it, for the hours they work for the company.
(3) Pizza Hut delivery drivers receive some amount of money as reimbursement for their vehicle expenses (i.e., gas, insurance, wear and tear, and repairs), but the plaintiff claims the money they receive is not enough.
The drivers argue that the company was required to either (1) keep track of and reimburse for the delivery drivers’ actual expenses, or (2) reimburse at the IRS standard business mileage rate (currently $.56/mile).
The plaintiffs in this case allege that Pizza Hut failed to comply with either option.
By failing to fully reimburse their delivery drivers, the plaintiff claims that Pizza Hut is taking a “kick back.” Because the automobile expenses are for the benefit of the business, Pizza Hut must fully reimburse for them. The plaintiff claims that their reimbursement policy falls short.
The plaintiff seeks the difference between the IRS rate and the rate that the company actually paid for reimbursement as damages in this case. In addition, the plaintiff will seek additional damages under federal and state law.
