Dayton area delivery drivers file arbitration against Hallrich, Inc.

Do you deliver for Hallrich, Inc. or North Coast Pizza, Inc. in Dayton, Ohio? If so, you may not have been properly reimbursed for your vehicle expenses (like gas, mileage, wear and tear, depreciation, etc.).

This month, Biller & Kimble filed arbitrations on behalf of two delivery drivers who worked for Hallrich, Inc., a Pizza Hut franchise operator who owns and operates the stores in the Dayton, Ohio area. The franchisee also operates under the name North Coast Pizza, Inc.

The drivers allege that state and federal law requires Hallrich to either (1) track and pay delivery drivers’ actual expenses, or (2) reimburse the drivers at the IRS standard business mileage rate, which is currently $.56 per mile. The drivers claim Hallrich did neither and instead paid about half of the IRS rate.

For each mile they drove for the company, the drivers seek to recover the difference between the IRS rate and the reimbursement they received. In addition, the drivers will seek damages under federal and state law, which can add up to 4x as much as their unpaid wages.
