Biller & Kimble Files Second Lawsuit Against Bajco, A Major Papa John’s Franchise Operator

On December 2, 2024, a Papa John’s delivery driver filed suit against the companies known collectively as the Bajco Group, one of the largest franchise operators of Papa John’s Pizza stores. The lawsuit – Beard v. Bajco –  was filed a year after Bajco settled (for 9 million dollars) a lawsuit alleging similar claims on behalf of over 8,000 Papa John’s delivery drivers who worked for the Bajco Group from July 28, 2019-October 3, 2023.

This case, similar to the previous lawsuit filed by Biller & Kimble, involves a plaintiff who claims that he and his fellow delivery drivers were being underpaid by the defendants who operate Papa John’s franchise stores across the county. The drivers allege that they were being underpaid because the defendants did not properly reimburse the drivers’ vehicle expenses.

The Plaintiff-driver in the current lawsuit argues that he and his fellow delivery drivers incurred vehicle expenses that exceeded the reimbursements they received from the Bajco Group for the use of their vehicles to deliver pizzas and other food items.  Because of this underpayment, the Plaintiff claims that his, and his fellow delivery drivers’ effective wages dropped below minimum wage.

The Plaintiff in the current lawsuit seeks to represent all delivery drivers at the Papa John’s Pizza stores operated by the Bajco Group across the country for state wage claims in addition to the FLSA claims asserted in these pizza driver style cases.
